Attorneys David C. Miller, Alan S. Zimmet, Nicole C. Nate and Ellie Nieberger Wrote Articles Featured in Local Government Symposium Issue

The legal scholarship — and its practical applications — of four of Bryant Miller Olive, P.A.’s (BMO) attorneys are on display in the annual Local Government Law Symposium issue of the Stetson Law Review, published by Stetson College of Law.

Both Miller and Nate are Stetson graduates, and both have published in the Stetson Law Review in the past.

David C. Miller, Esq., of BMO’s Miami offices, authored “Taking the ‘Urgent’ Out of Financial Urgency in Florida Public Sector Labor Law.” Alan S. Zimmet and Nicole C. Nate, of BMO’s Tampa offices; and Ellie Nieberger, of the Miami office, authored “Pilot Agreements Have Liftoff: City of Largo v. AHF-Bay Fund, LLC.”

Miller’s article explores the Florida Supreme Court’s initial interpretation of the “Financial Urgency” section of the law governing relations between unions and public employers, such as cities, counties, and school districts. He argues that the purpose of the law was to allow quick action to avoid looming financial crisis. He concludes that the court’s decision has made that impossible.

Zimmet, Nieberger and Nate examine another recent Florida Supreme Court decision on a challenge to “PILOT” agreements, which permit local governments to contract with otherwise tax-exempt land owners to pay for government services that would normally be supported through tax revenues.

The challengers won in the lower court, and the ruling would have taken a valuable tool away from local governments wishing to use PILOT agreements for sharing some of the risk of loss with a developer. However, BMO was successful in convincing the Florida Supreme Court to confirm this approach. The Stetson Law Review article explains how the case creates a valuable legal precedent for local governments to use their proprietary powers through PILOT arrangements.
