Court Challenge Can Proceed Against DMV Decision Allowing Tesla Store To Open In Henrico County

A court case will be allowed to proceed challenging electric car maker Tesla’s eligibility to open a company-owned store in the Richmond area.

The Virginia Court of Appeals handed down a decision Tuesday that effectively enables the legal challenge to proceed in Richmond Circuit Court. The appeals court said it lacks jurisdiction to overturn the circuit court’s decision that the Virginia Automobile Dealers Association has legal standing in the matter.

In late 2016, Virginia DMV Commissioner Richard Holcomb decided that Tesla Motors Inc., a California-based maker of battery-powered cars, could open a company-owned store in the Richmond area.
